# Terms of Service

### 1) Introduction

These Terms of Service (“Terms”) govern your access to and use of the Fuyo Markets website(s), app(s), and related services (collectively, the “Services”), including any features that allow you to deposit funds, place prediction positions, and withdraw funds.

By accessing or using Fuyo Markets, you confirm that you:

* have read and understood these Terms,
* agree to be bound by them, and
* are legally permitted to use the Services in your jurisdiction.

> If you do not agree to these Terms, do not use Fuyo Markets.

### 2) What Fuyo Markets Is (and isn’t)

Fuyo Markets is a house-based prediction market platform. That means:

* Fuyo offers markets (YES/NO or Higher/Lower) with quoted odds
* you place positions against other players using PMM — Parimutuel Market Maker.
* positions fill based on Fuyo’s live quote at confirmation

Fuyo Markets is not:

* a peer-to-peer orderbook exchange
* a broker, custodian, or trustee for your wallet (unless explicitly stated for specific fiat/card features)
* financial, legal, or investment advice

### 3) Eligibility (Age + Legal Authority)

You must be 18 years old or older to use Fuyo Markets.

If you use Fuyo Markets on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.&#x20;

### 4) Restricted Jurisdictions and Prohibited Use

Fuyo Markets may not be available in certain jurisdictions (“Restricted Jurisdictions”). You must not use Fuyo Markets if:

* you reside in, are located in, or are a citizen/resident of a Restricted Jurisdiction, or
* you are using the Services on behalf of someone in a Restricted Jurisdiction.

We may use reasonable methods (including geolocation and compliance checks) to enforce restrictions. Circumventing restrictions (including use of VPNs or similar tools to evade them) may lead to account limitations or blocks.&#x20;

The Services, including the Site, are made available by us from the BVI and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the BVI.

### 5) Wallets, Deposits, and Withdrawals

#### A) Self-custody wallets

If you connect a self-custody wallet (e.g., MetaMask), you are solely responsible for:

* securing private keys and passwords
* verifying addresses and networks
* any transactions you sign

Blockchain transactions are generally irreversible. We cannot reverse mistaken transfers.&#x20;

#### B) Supported collateral and networks (current)

* USDT (BEP-20) on BNB Chain for mainnet usage. More stablecoins and additional blockchain networks will be introduced in the near future.

#### C) Fees and network costs

You may be responsible for:

* blockchain network gas fees (e.g., BNB Chain fees)
* any platform fees shown before confirmation (if applicable)

#### D) Coming soon: card/fiat rails

If Fuyo enables VISA/Mastercard deposits or fiat withdrawals, additional terms may apply, including third-party provider terms and identity verification.

### 6) Trading and Market Outcomes

#### A) Market rules control

Each market includes a Rules section. The Rules determine:

* what counts as YES/NO (or Higher/Lower)
* the exact expiry time / resolution window
* the data sources used for settlement
* edge cases (postponements, outages, ambiguity)

#### B) Final settlement

At market expiry, Fuyo settles positions based on the Rules and the resolution process described below.

#### C) Risk disclosure

Trading prediction outcomes is speculative. You can lose the amount you stake. Past results do not predict future results.

### 7) Oracle & Resolution (Data Sources)

Markets are resolved using the data sources specified in that market’s Rules. Sources may include:

* Binance live feed API data
* Bybit websocket data stream
* Chainlink data streams
* other third-party data sources, depending on market type
* Additional other data sourced used as oracle will be added in the near future

### 8) Disputes and Refund Policy (Data Quality)

If a market cannot be resolved reliably due to data quality issues (for example: missing, inconsistent, or materially conflicting data not covered by the Rules), Fuyo may declare that market Refunded/Invalid and:

✅ refund all traders in that specific market (returning stakes)

A refund means:

* no side is declared the winner
* positions are closed as refunded
* stake amounts are returned (excluding any non-refundable network fees already paid to a blockchain)

### 9) Prohibited Conduct

You agree not to:

* attempt to exploit or manipulate markets, settlement, or platform systems
* engage in fraud, money laundering, or illegal activity
* use bots or scripts to abuse promotions or rewards
* harass users or staff, or submit malicious content
* interfere with platform security, availability, or integrity

We may restrict, suspend, or terminate access to protect the platform and users.

### 10) Third-Party Services

Fuyo Markets may link to or integrate with third parties (wallet providers, data providers, payment processors). We do not control their services and are not responsible for their actions, policies, or outages.&#x20;

### 11) Modifications to the Services or Terms

We may update these Terms and modify the Services at any time. Updated Terms will be posted with a new “Last Updated” date. Continued use means you accept the updated Terms.&#x20;

### 12) Disclaimers and Limitation of Liability

Fuyo Markets is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability or error-free operation. Blockchain networks and third-party providers can fail or become unavailable.&#x20;

To the maximum extent permitted by law, Fuyo is not liable for indirect or consequential losses, including losses from:

* market volatility
* user error (wrong address/network)
* blockchain downtime
* third-party outages
* phishing, hacks, or compromised user devices/wallets

### 13) Dispute Resolution, Arbitration, and Class Action Waiver

If you have a dispute with Fuyo, you agree to attempt informal resolution first by contacting us at: <support@fuyo.markets>

If unresolved, disputes may be resolved by binding arbitration in BVI, on an individual basis only, and not as a class action, subject to applicable law.&#x20;
